Apply for a Certificate of Lawfulness

A Certificate of Lawfulness of Proposed Works to a Listed Building confirms that you do not need listed buildings consent for the works.

If you are the owner, or acting for the owner of a listed building, you can apply for a lawful works certificate. This is to confirm that proposed works to a listed building would be lawful.

If the proposed works are lawful, we'll issue the certificate.

This will confirm that the works described in it do not:

  • affect the character of the listed building
  • require consent

You must do the works works deemed to be lawful in the certificate within 10 years of the date of the certificate.

How to apply

To apply:

  • read the guidance note to find out what information you need to provide
  • complete the application form
  • return the form to the Planning team

Applying for both Listed Building Consent and a lawfulness certificate

You may be submitting a separate application for Listed Building Consent for works you know or have been told need consent.

If you're not sure which application certain works should go into, put them in your Listed Building Consent application.

What happens next

We must give a written decision within six weeks. This begins the day after the receipt of a valid application, unless further time is agreed. 

There is no charge for this service.
