Selling or changing use of a listed asset

If a landowner wants to sell an asset that is on the list of assets of community value, they must tell us. If this happens:

  1. we will publicise that there is a proposed disposal of an asset in the local area
  2. we will inform the group or groups who have nominated the site of the proposed disposal
  3. a voluntary or community group have six weeks to respond if they want to buy the asset. They will then have six months to put a bid together. In this time, the property cannot be sold
  4. the landowner can sell the property to anyone after six months. Or decide not to proceed with the sale

Being listed as an asset of community value:

  • does not mean the landowner has to sell the asset to a community group
  • means the landowner must give community organisations an opportunity to prepare a bid to buy the asset

Change of use and planning applications

If a drinking establishment is nominated or included on the list, the owner must get planning permission to change it's use or demolish the building, from the point it is nominated.

This is required by the Town and Country Planning (General Permitted Development) (Amendment) Order 2015.

This will remain the case until the drinking establishment is placed on the list of unsuccessful nominations. Or if it is successfully nominated as an Asset of Community Value, for five years from the point of listing.
