Terms and conditions for successful Greenwich Get Active grant applicants

The grant must be spent for the purpose it was awarded, as described in the offer letter. The Royal Borough of Greenwich must be kept up to date with information about the progress of your project, and if the completion date or proposed outcome of the project is likely to change in any way.

Failure to return an evaluation report within six weeks of the project completion date may mean that you are ineligible for future funding from any Greenwich Get Active funding schemes. Failure to complete the report within the timescale could result in the organisation being asked to repay the grant.

3.

All projects should be completed within one year of the start date. It is important to contact the Royal Borough of Greenwich if you foresee that your project will not be completed within the time restriction as it may result in funds being forfeited.

4.

The Greenwich Get Active Grant is unable to fund:

  • projects which are for private gain or result in a profit being made
  • events which are primarily fundraising activities
  • study or training fees of any kind including activities which are a required component of educational courses
  • activities which promote a particular political or religious view, or any project which entices racial, religious or sexual hatred or extremism
  • refreshments or meals
  • core running costs or overheads (e.g. utilities or rent) unless there are exceptional circumstances
  • loan repayments
  • VAT
  • budget deficits
  • endowments
  • activities which do not benefit the residents of Greenwich
  • activities which have already taken place
  • duplication of existing events of projects in the borough
  • ongoing projects, activities which you currently deliver.

Required permissions and invitations:

Where relevant, you must provide copies of adequate Public Liability Insurance before the first grant payment is made. The minimum amount of cover required for Public Liability Insurance is £1 million, unless agreed otherwise. The insurance must be maintained during the period of the grant.

If you are using any parks, outdoor space or facility managed by the Royal Borough of Greenwich you must have the appropriate permits in place, and for private venues you must have appropriate permission to conduct your event / activity.

7.

It is a condition of this grant that you will comply with any statutory requirements relating to working with children and vulnerable adults.  You will be required to carry out the necessary Disclosure and Barring Service (DBS), before appointing staff to work unsupervised with children under the age of 18 years and/or vulnerable adults and you are also required to follow any guidance which may be issued by the Royal Borough of Greenwich.

When a grant may be repaid:

Without prejudice to our other rights and remedies, the Royal Borough of Greenwich reserves the right to withhold or suspend payment of the grant or to require repayment either in part or whole where (including but without limitation):

  • we identify that the grant underwrote a financial risk which was made good
  • you cease to operate, are declared bankrupt, or are placed into liquidation or receivership or administration or enter into any other similar arrangement
  • you fail to use the grant for the purpose for which it was obtained or fail to complete the project within the agreed timeline
  • you fail to comply with the conditions of the grant at any time during the period of the grant
  • you completed the application form fraudulently or negligently
  • you fail to complete the report within six months of receiving the grant you receive duplicate funding from a third party
  • you take any actions or receive funding from any third party which, in our reasonable opinion, undertakes activities that can bring the project or the Royal Borough of Greenwich or Greenwich Get Active into disrepute.

You are required to inform the Royal Borough of Greenwich of any financial or other difficulties which may have a material impact on your delivery of the project or that may result in you being unable to comply with these terms and conditions.

Acknowledging the grant, publicity, advertising and promotion:

To the best of your ability, you are required to acknowledge the support of the Royal Borough of Greenwich/Greenwich Get Active within any written information about the project, including (but without limitation) press articles and event programmes.

Misuse of the Royal Borough of Greenwich/Greenwich Get Active logos and/or failure to adhere to the guidelines may result in the Royal Borough of Greenwich/Greenwich Get Active preventing the public distribution of the offending publicity material.

By receiving a grant, you agree to allow the Royal Borough of Greenwich/Greenwich Get Active to make use of your Project details for internal and external promotion, including through our website. If the Royal Borough of Greenwich/Greenwich Get Active wish to use details about your project as part of its own promotion schemes we will endeavour to inform you beforehand.

By receiving the grant, you agree to upload your project details on to open sessions which feeds Greenwich Get Active’s activity finder website.

General:

By receiving a grant, you acknowledge that the Freedom of Information Act 2000 (FOIA) and the Environmental Information Regulations 2004 (EIRs) requirements apply. If requests for information or transfers are made by the Royal Borough of Greenwich, you agree to assist and cooperate as necessary.

If requests for information are received from third parties under the FOIA and EIRs, you agree to inform the Royal Borough of Greenwich as soon as reasonably possible and to wait for consent to respond directly to the request.

By receiving the grant, you agree to comply with all data protection legislation and all applicable obligations in force from time to time in the UK, including those contained in the Data Protection Act 2018 and UK General Data Protection Regulation.

17.

By receiving the grant, you agree to not unlawfully discriminate on the grounds of any protected characteristics in employment or otherwise. You agree to take all reasonable steps to ensure all employees, suppliers, subcontractors and agents engaged on the project will comply with all anti-discrimination legislation and regulations.

Any intellectual property rights owned by either party or developed by either party during the period of the grant will remain the property of that party.

19.

The Royal Borough of Greenwich do not accept any liability for any consequences, whether direct or indirect, that may come from your use of the Grant or your running of the project. You shall indemnify and hold harmless the Royal Borough of Greenwich  with respect to all claims, demands, actions, costs, expenses, losses, damages and all other liabilities arising from or incurred in relation to the project.

20.

Subject to term 19, The Royal Borough of Greenwich’s liability under these terms and conditions is limited to the payment of the grant.

21.

The Royal Borough of Greenwich may terminate these terms and conditions and any Grant payments for any reason by giving you three months written notice.

22.

You may not assign, transfer, sub-contract or in any other way make over to any third party the benefit and/or the burden of these terms and conditions or transfer or pay any part of the grant to any other person, except as contemplated as part of the project.

In the event of any complaint or dispute in relation to these terms and conditions or the payment of the grant, the matter should be referred to the project manager for resolution.

Should any complaint or dispute remain unresolved after 14 days of being referred to the project manager, you can refer it to a senior member of the Royal Borough of Greenwich  to be resolved by agreement within 28 days.

25.

By receiving the grant, you acknowledge and agree that this does not create any partnership or joint venture between you and the Royal Borough of Greenwich, nor any relationship of principal and agent.

26.

These terms and conditions do not confer any contractual benefit on any person pursuant to the Contracts (Rights of Third Parties) Act 1999.

27.

These terms and conditions shall be governed by and construed in accordance with the law of England and the parties submit to the exclusive jurisdiction of the English courts.
